Straipsnyje aptariamos šešios reduktyvizmo strategijos – sąvokų sinonimija paremta redukcija, a posteriori tapatybės tezė, analitinis funkcionalizmas, anomalusis monizmas, analizė pasitelkiant pareities sąvoką, konceptualinė analizė be sąvokų sinonimijos – ir konstatuojama, kad skirtingose filosofijos srityse šios strategijos reiškiasi skirtingai, taip pat yra skirtingai kritikuojamos ir interpretuojamos. Straipsnyje mėginama paaiškinti kai kuriuos šių skirtumų ir daroma (...) išvada, kad šiuolaikinėje analitinėje filosofijoje neperspektyvu kalbėti apie reduktyvizmą apskritai, kaip vieną visas sritis apimantį reiškinį, paremtą visas reduktyvistines koncepcijas vienijančiu reduktyvizmo modeliu, forma ar vizija. The author tries to explore several new amendments to the penal code of Lithuania, made by the Law on 2 December 2010. The first amendment concerns article 72 of the Penal code of Lithuania (confiscation of property). Prior to the year 2003, confiscation of property implied the right of the court to confiscate any property in possession of the sentenced person. However the Penal code of 2003 set up a new concept of confiscation: just proceeds of the crime or objects (...) intended to be used in committing a crime should be confiscated. However practice was very poor. New law aimed at boosting practice of confiscation, particularly from third persons, to whom usually the offender transfers property. Previous wording of the law provided for that the property should be confiscated from the third person just in case the person knew or could know that the property that he possesses is from a crime. The law of 2010 added new alternative conditions. (shrink)

Is the procreation asymmetry intuitively supported? According to a recent article in this journal, an experimental study suggests the opposite. Dean Spears (2020) claims that nearly three-quarters of participants report that there is a reason to create a person just because that person’s life would be happy. In reply, I argue that various confounding factors render the study internally invalid. More generally, I show how one might come to adopt the procreation asymmetry for the wrong reasons by misinterpreting one’s intuitions.

This article focuses on the analysis of the main positions of the Constitutional Court of the Republic of Lithuania in the cases of intellectual property law. In the article three judgments and the positions of the Constitutional Court extracted therefrom are analysed. The Constitutional Court has formed several important positions with reference to intellectual property law regarding usage of property protection norms for the protection of intellectual property, requirements of application of compensation as an alternative to damages compensation and the (...) calculation of criterions thereof as well as functional legal protection of trademarks. It should be noted that Article 23(1) of the Constitution of the Republic of Lithuania has extended protection to property and, as the Constitutional Court of the Republic of Lithuania has noted, the constitutional protection of property covers not only the protection of tangible, but also of intellectual property. In the same judgment, the Constitutional Court stated another important intellectual property related rule, namely that constitutionally established property protection rights have to be implemented regardless of whether a corresponding international treaty has not been ratified, as protection of authors’ rights is granted under Articles 23 and 42(3) of the Constitution of the Republic of Lithuania. However, the second position stating that the rights of foreign subjects are to be implemented even though a corresponding international treaty has not been signed is to be criticised as by coming to such a conclusion the Constitutional Court has ignored the otherwise generally recognised principle of territoriality of intellectual property rights. In two other cases the Constitutional Court has made important statements relevant to intellectual property law. First of all, the Court stated that compensation instead of claiming actual damages is constitutional. By analysing the positions formulated by the Court, an indirect conclusion can be made to the effect that compensation instead of claiming actual damages is necessary in order to ensure effective protection of intellectual property rights. In other words, the purposes of compensation can be recognised: restoring (compensating) the infringed interests of the injured party; simplifying judicial proceedings, whereby faster proceedings (litigation) and easier substantiation is sought; and the preventive purpose (strong preventive effect). However, the Court’s argument regarding the criterion of compensation calculation, saying that the damages incurred by the intellectual property rights owner depend on the sale value of the product concerned is criticisable, as it is rarely the case that the licence fee or profit acquired in the result of unauthorised use of intellectual property objects is calculated with reference to the final sale price of the product. Notwithstanding the arguably weak argument of the Court, the Court’s position regarding the criterion of final sale price itself does not preclude the possibility of reaching a fair final decision. Finally, the Court acknowledged that trademark protection was limited to the economic functions of the trademark and the full protection thereof. (shrink)

The paper deals with the paradox that rationality demands rational substantiation which can’t be given in principle. Thus it is argued that only intuition can prevail against skepticism and subjectivism. But intuition is "transcendent" to rationality and therefore its acceptance as the substantiation of rationality implies existence of transcendental reality. In itself it has infinite regress qua infinite reiteration of reality levels without any qualitative ontological alteration, therefore only infinite transcendence is able to ground a finite immanence.

This paper offers a unified explanation for the procreation asymmetry and the non-identity thesis – two of the most intractable puzzles in population ethics. According to the procreation asymmetry, there are moral reasons not to create lives that are not worth living but no moral reasons to create lives that are worth living. I explain the procreation asymmetry by arguing that there are moral reasons to prevent the bad, but no moral reasons to promote the good. Various explanations for the (...) procreation asymmetry have failed to explain the non-identity thesis: if one could create a person with a good life or a different person with a better life, one has a moral reason to create the better life. I argue that reflections on the misfortune of unfulfilled potential allow us to circumvent the non-identity problem. (shrink)

According to the general rule explaining apparent authority, if the behaviour of a principal gives reasonable grounds for the third party to think that the principal has appointed the other person to be his agent, contracts concluded by the third party in the principal’s name shall be binding on the principal, notwithstanding the fact that the agent was not authorised by the principal to conclude particular contracts. In the absence of evidence of apparent authority the agent shall have to redress (...) the damage incurred on a third party in cases where the third party was not aware, and was under no obligation to be aware, of circumstances that the person acted in other person’s name without their express authorisation or in excess of their authority. The principal shall be liable for actions of the apparent agent if the following three requirements are proven: words or conduct of the principal caused the impression of authority; third party could reasonably presume the existence of sufficient authority; third party acted in good faith. The third party’s legitimate expectations must be aligned with the principal’s will in order to apply the doctrine of apparent authority efficiently. (shrink)

The recent Lithuanian court practice shows discrepancies in cases dealing with partitioning of common partial divided property. Moreover, no doctrinal research has been concluded on the limits and conditions of the co-owners‘ right to demand that his share should be partitioned from the common partial ownership in Lithuania. Taking into account that proper implementation of co-ownership rights is based on common agreement of co-owners, when no agreement is reached between co-owners regarding the fact and the mode of partitioning, a question (...) arises on what conditions and to what extent the co-owner is free to implement his right to demand partitioning of his share from the common partial ownership. The research on historical developments of the partition law in different European countries shows that the co-owner’s right to partition is based on the idea of pluralistic conception of the modern property law objects. The authors of this article argue that this conception allows the co-owner to enjoy the right to dispose of his share in the common ownership as a separate object of civil turnover at his own volition and without the other co-owner’s consent. However, the right to partition is not absolute and is limited by the rights of the other co-owner to his share of the same property, so the right to partition may be implemented only following the proportionality and interest balance between the co-owners. Taxation of residential property is difficult to be implemented in many jurisdictions and in this respect Lithuania is not an exception. Many taxpayers do not comprehend why property should be levied by the government. Indeed, any owner of real estate would usually resist to any attempts to increase this tax burden. However, even when the threshold is once overstepped and a new unpopular statutory framework is introduced, the government still faces new dilemmas regarding the administration of this tax. Sometimes weak (...) tax administration but not the tax itself undermines the credibility of the public. Commercial premises as well as land have been continuously levied in the Republic of Lithuania since 1990. Thus, the taxes paid by enterprises and the land tax were not a big issue of public debate in Lithuania. The burden of this tax was not very significant in the light of all taxes paid by enterprises or land owners. The most problematic issue remains the taxation of residential property. (shrink)

Is there a pro tanto moral reason to create a life merely because it would be good for the person living it? Proponents of the procreation asymmetry claim there is not. Defending this controversial no reason claim, some have suggested that it is well in line with other phenomena in the moral realm: there is no reason to give a promise merely because one would keep it, and there is no reason to procreate merely to increase the extent of justice (...) in the world. Allegedly, some analogs extend so far as to support a unified theory of the no reason claim and the nonidentity thesis, that is, the view that of two persons leading lives of positive wellbeing, there is a reason to create the person with higher wellbeing. I dismantle the proposed analogs and show that they fail to meet various desiderata. Moreover, I refute Johann Frick's argument that the no reason claim follows from the assumption that reasons of beneficence are reasons to act for the sake of people. By criticizing attractive defenses for the no reason claim, I weaken its plausibility. (shrink)

The present article aims to show the effects that the coalescence of liberal democracy and globalisation has on the law as a social institution. The law as a social institution is one of the key foundations for the social integration of modern society, which is why we may suggest a reasonable assumption that the role of the law in modern Western societies should be growing in significance. However, the coalescence of liberal democracy and globalisation is a consequence of the evolution (...) of modern Western civilisation and the main context of its further development that gives feedback to the very development process. The analysis of the crisis of the financial capital makes us question the previous assumption because the essence of the law as a social institution lies not in its legal regulation but in its self-regulation that should increase the society’s trust in different institutions, including the financial capital. The present research makes an attempt to answer the following questions: 1) what is the traditional role of the relationship between society and the law as a social institution? 2) what are the most important social consequences of the coalescence of liberal democracy and globalisation? 3) what is the significance of the legal culture under the circumstances of the coalescence of liberal democracy and globalisation? The present article explores the inner tensions of the legal culture in consumer society as a consequence of the interaction between democracy, liberalism and market economy under globalization. The interaction between democracy and modern political thought has given rise to liberal democratic society, moral and religious pluralism, and modern law. The interplay between liberal democracy and the market (“new liberalism”) has generated the idea of “instrumental reason”, whose penetration into many realms of life has transformed the structure of society and (...) democracy itself: consumer society and a dangerous tendency of social decline prevail. Under the expansion of globalization and social decline, instrumental law may not be enough to ensure the functioning of society. On 21 June 2011 the Parliament of the Republic of Lithuania adopted extensive and important amendments of the Code of Civil Procedure of the Republic of Lithuania. Most of them came into force on 1 October 2011.One of the important tasks that have been mentioned for the preparation of amendments was to ensure the implementation of the Constitutional Court’s doctrine of matters of civil procedure. This article analyses one of the changed aspect - the system of defence of public interest. (...) The doctrine of concept of public interest was formed by the resolutions of the Lithuanian Constitutional Court adopted on 16 January and 21 September 2006. That concept was quite confusing and could be interpreted widely as well as narrowly (such as protection of special key values in the Constitution). This paper analyses the manner in which the doctrine of the Constitutional Court has been implemented in the law of civil procedure. In addition, the article analyzes the history of the amendments in the Code of Civil Procedure relating to the protection of public interest. The author presents a situation proposed to the Working Group that prepared the draft amendments to the Code of Civil Procedure, and compares the proposals with the effective version of the Code of Civil Procedure. The same article analyses the way that the effective version of the Code of Civil Procedure forces to the protection of the public interest doctrine of the Constitutional Court. The author concludes that the current system is conducive to abuses when the state can envisage the existence of public interest in every dispute and intervene in its investigation. In addition, the court is transformed into an entity liable to defend public interest, while it should be an independent and impartial entity to administer justice. Let us hope that in judicial practice the concept of public interest will be interpreted very narrowly and the Code of Civil Procedure provides the right to collect evidence or apply interim protection measures and etc. will be seen as a political mistake and generally will not be applied (except when it comes to non dispositive cases). Experiences—visual, emotional, or otherwise—play a role in providing us with justification to believe claims about the world. Some accounts of how experiences provide justification emphasize the role of the experiences’ distinctive phenomenology, i.e. ‘what it is like’ to have the experience. Other accounts emphasize the justificatory role to the experiences’ etiology. A number of authors have used cases of cognitively penetrated visual experience to raise an epistemic challenge for theories of perceptual justification that emphasize the justificatory role of phenomenology rather (...) than etiology. Proponents of the challenge argue that cognitively penetrated visual experiences can fail to provide the usual justification because they have improper etiologies. However, extant arguments for the challenge’s key claims are subject to formidable objections. In this paper, I present the challenge’s key claims, raise objections to previous attempts to establish them, and then offer a novel argument in support of the challenge. My argument relies on an analogy between cognitively penetrated visual and emotional experiences. I argue that some emotional experiences fail to provide the relevant justification because of their improper etiologies and conclude that analogous cognitively penetrated visual experiences fail to provide the relevant justification because of their etiologies, as well. We discuss the idea that superpositions in quantum mechanics may involve contradictions or contradictory properties. A state of superposition such as the one comprised in the famous Schrödinger’s cat, for instance, is sometimes said to attribute contradictory properties to the cat: being dead and alive at the same time. If that were the case, we would be facing a revolution in logic and science, since we would have one of our greatest scientific achievements showing that real contradictions exist.We analyze that (...) claim by employing the traditional square of opposition.We suggest that it is difficult to make sense of the idea of contradiction in the case of quantum superpositions. From a metaphysical point of view the suggestion also faces obstacles, and we present some of them. (shrink)

How does history relate to the past? According to leading historical theorists, the relation to the past in history is reducible to evidential, psychological, practical and retrospective concerns. In contrast, this volume claims that historical relations to the past are irreducible products of the logical commitments of history as method. Ahlskog argues that the method of history shapes and enables relations to past in historical research by invoking past perspectives of meaning for rendering reality intelligible. Following J.-Y.Béziau in his pioneer work on non-standard interpretations of the traditional square of opposition, we have applied the abstract structure of the square to study the relation of opposition between states in superposition in orthodox quantum mechanics in [1]. Our conclusion was that such states are contraries, contradicting previous analyzes that have led to different results, such as those claiming that those states represent contradictory properties. In this chapter we bring the issue once again into the center of the (...) stage, but now discussing the metaphysical presuppositions which underlie each kind of analysis and which lead to each kind of result, discussing in particular the idea that superpositions represent potential contradictions. We shall argue that the analysis according to which states in superposition are contrary rather than contradictory is still more plausible. (shrink)

In this work, we focus on a very specific case study: assuming that quantum theories deal with “particles” of some kind, what kind of entity can such particles be? One possible answer, the one we shall examine here, is that they are not the usual kind of object found in daily life: individuals. Rather, we follow a suggestion by Erwin Schrödinger, according to which quantum mechanics poses a revolutionary kind of entity: non-individuals. While physics, as a scientific field, is not (...) concerned with whether entities posited by a specific physical theory are individuals or not, answering this question is part of the quest for a better understanding of physical reality. Here lies, in large measure, the relevance of ontology. (shrink)

The strategy of developing an ontology or models of disability as a prior step to settling ethical issues regarding disabilities is highly problematic for two reasons. First, key definitional aspects of disability are normative and cannot helpfully be made value-neutral. Second, if we accept that the contested concept of disability is value-laden, it is far from obvious that there are definitive reasons for choosing one interpretation of the concept over another. I conclude that the concept of disability is better left (...) ethically open-ended or broad enough to encompass the examination of various ethical issues. Alternatively, the concept of disability could be altogether abandoned in order to focus on specific issues without being hindered by debates about the nature of disability. Only political costs, rather than conceptual considerations internal to the models, could be weighed against such a conclusion. (shrink)

This paper concerns how extant theorists of predictive coding conceptualize and explain possible instances of cognitive penetration. §I offers brief clarification of the predictive coding framework and relevant mechanisms, and a brief characterization of cognitive penetration and some challenges that come with defining it. §II develops more precise ways that the predictive coding framework can explain, and of course thereby allow for, genuine top-down causal effects on perceptual experience, of the kind discussed in the context of cognitive penetration. §III develops (...) these insights further with an eye towards tracking one extant criterion for cognitive penetration, namely, that the relevant cognitive effects on perception must be sufficiently direct. Throughout these discussions, we extend the analyses of the predictive coding models, as we know them. So one open question that surfaces is how much of the extended analyses are genuinely just part of the predictive coding models, or something that must be added to them in order to generate these additional explanatory benefits. In §IV, we analyze and criticize a claim made by some theorists of predictive coding, namely, that (interesting) instances of cognitive penetration tend to occur in perceptual circumstances involving substantial noise or uncertainty. It is here that our analysis is most critical. We argue that, when applied, the claim fails to explain (or perhaps even be consistent with) a large range of important and uncontroversially interesting possible cases of cognitive penetration. We conclude with a general speculation about how the recent work on the predictive mind may influence the current dialectic concerning top-down effects on perception. (shrink)

Postmodernybę charakterizuoja populiariosios ir medijų kultūros išplitimas. Tos kultūros apima ne tik kultūros prekes, bet ir vartojimo būdus, įgūdžius ir jų lavinimą. Pastaruoju metu jos kuria nemirtingumo vaizdiniams bei nuojautoms palankią kultūrinę, intelektinę ir pasaulėvaizdinę terpę, kurioje struktūriškai įsitvirtina genetinis diskursas ir jo nustatomos žmogaus ir jo gyvenamo pasaulio aiškinimo gairės. Svarbus šio diskurso bruožas yra technologinis inžinerinis jo pobūdis, išryškėjęs susiejant nano (...) ir biotechnologijas, kuriomis tikimasi įveikti gyvąją ir negyvąją gamtą skiriančią prarają, iš reikalingų atomų bei molekulių kuriant reikalingų ląstelių dalis ir klonuojant gyvas būtybes. Gyvybė suprekinama ir suišteklinama patentuojant gyvybės elementus – genus ir su jais susijusius procesus. Daroma išvada, jog visi genetikos, informatikos ir kitų mokslų laimėjimai, teikiantys žmogaus gyvenimo ilginimo galimybių, kurios palaiko gundančią nemirtingumo idėją, jau yra persmelkti prekinių santykių, tad ir pats nemirtingumas įmanomas tik kaip prekė. Genetic Discourse in Media Culture: Temptation by Commodified Immorality Vytautas Rubavičius Summary Postmodernity is maintained as a stage of the development of capitalism. The difference between modernity and postmodernity is explained in relation to the new sphere of commodification and resourcification, namely, that of life and of all natural living processes. Postmodern media culture, or popular culture, is peopled by signs of immortality and various kinds of immortals – cyborgs, clones, zombies, immortal human beings and others. Thus, culture accustoms a consumer to immortals and immortality which is concidered as the main goal of a human being and evolution. By nano-bio-technologies and genetic discourse this goal is made scientifically valid, thus reachable. Genetic discourse is becoming the fundamental world-view providing focal landmarks for the emerging future. Media culture supports the spreading of genetic discourse and facilitates its understanding. The temptation by immortality can be considered as a version of modernist ideology of human liberation from various natural, social and heavenly bonds. This liberation, and also secularization, is supported by a scientific genetic technological discourse which is becoming a stimulating factor of postmodern media production. The genetic explanation of the world is particularly handy for technological reflexivity: the entire world is as if encapsulated into human genes, which become the principle explaining the mystery of life, evolution and the future of humanity, thus rendering power to produce the human proper form and the future of people. All the possibilities stemming from the new genetic and biotech discoveries fell under the regulation of property relations by patenting, thus making “immortality” – as a temptation and brand – not only an exeptional commodity, but also a political tool and a commodifying force. As the relationships of private property have penetrated natural biogenetic diversity and, having turned it into a resource, the cognitive subject has reached the goal to secularise the Universe, which he has set for himself: only he as the owner and producer of genes lures people with the eternal shapes of the clones and their genetic information, which will be sustained in any location of the Universe. The temptation by “immortality” will become even stronger when the genetic code is mastered. The future of humanity is related to the mixed forms of life, trans-genic or otherwise genetically modified organisms and techno-human forms that will help to postpone, and later to conquer, death. Even thinkers with religious tendencies perceive the technological improvement of human beings as their evolution towards the techno sapiens and consider such a development as an advancement towards the Kingdom of God. The technologization of human beings is imagined in terms of their divination. Yet in this case the character of contemporary science secularising God and obliterating the perception of divinity is overlooked. Two versions of immortality are analyzed more closely – that of Z. Bauman, who links it with the development of computer technologies, and that of J. Baudrillard, who gives a warning that by cloning technologies humanity is trying to inverse the evolution and to return to the undifferentiated state of cells. The conclusion is drawn that regardless of how we understand ‘immortality,’ argue over its reality or unreality, all possibilities to prolong human life granted by genetics, informatics and other advances in science and technologies, which support the tempting idea of immortality, have already been penetrated by commodity relationships; therefore, “immortality” itself will be available only as a commodity. Scientific realism is typically associated with metaphysics. One current incarnation of such an association concerns the requirement of a metaphysical characterization of the entities one is being a realist about. This is sometimes called “Chakravartty’s Challenge”, and codifies the claim that without a metaphysical characterization, one does not have a clear picture of the realistic commitments one is engaged with. The required connection between metaphysics and science naturally raises the question of whether such a demand is appropriately fulfilled, and how (...) metaphysics engages with science in order to produce what is called “scientific metaphysics”. Here, we map some of the options available in the literature, generating a conceptual spectrum according to how each view approximates science and metaphysics. This is done with the purpose of enlightening the current debate on the possibility of epistemic warrant that science could grant to such a metaphysics, and how different positions differently address the thorny issue concerning such a warrant. Nonrelativistic quantum mechanics (QM) works perfectly well for all practical purposes. Once one admits, however, that a successful scientific theory is supposed not only to make predictions but also to tell us a story about the world in which we live, a philosophical problem emerges: in the specific case of QM, it is not possible to associate with the theory a unique scientific image of the world; there are several images. The fact that the theory may be compatible with distinct (...) ontologies, and that those ontologies may themselves be associated with a plurality of metaphysical approaches, gives rise to the problem of metaphysical underdetermination. This paper concludes that the available metametaphysical criteria fail to deliver objectivity in theory choice, and it puts forward its own criterion based on a tension between two methods of metaphysical inquiry: one that is closely related to science and another that is not. In this paper we deal with two applications of the square of opposition to controversial issues in the philosophy of quantum mechanics. The first one concerns the kind of opposition represented by states in superposition. A superposition of “spin up” and “spin down” for a given spatial direction, for instance, is sometimes said to originate particular kinds of opposition such as contradictoriness. The second application concerns the problem of identical particles. Identity and indiscernibility are entangled in discussions of this problem (...) in such a way that a proper conceptual treatment of those issues through the square seems profitable. (shrink)

A close examination of the literature on ontology may strike one with roughly two distinct senses of this word. According to the first of them, which we shall call traditional ontology , ontology is characterized as the a priori study of various “ontological categories”. In a second sense, which may be called naturalized ontology , ontology relies on our best scientific theories and from them it tries to derive the ultimate furniture of the world. From a methodological point of view (...) these two senses of ontology are very far away. Here, we discuss a possible relationship between these senses and argue that they may be made compatible and complement each other. We also examine how logic, understood as a linguistic device dealing with the conceptual framework of a theory and its basic inference patterns must be taken into account in this kind of study. The idea guiding our proposal may be put as follows: naturalized ontology checks for the applicability of the ontological categories proposed by traditional ontology and give substantial feedback for it. The adequate expression of some of the resulting ontological frameworks may require a different logic. We conclude with a discussion of the case of orthodox quantum mechanics, arguing that this theory exemplifies the kind of relationship between the two senses of ontology. We also argue that the view proposed here may throw some light in ontological questions concerning this theory. (shrink)
